neighbor got upset is putting fence up blocking acess to my property because the property of mine was on the opposite side of my fence he was using it to look like his own,, he tore it up before asking me to ride on it.. It was to late to say anything then my father moved in close to the fence on (the fenced in part) the guy rode his bike tearing more property up throwing dirt , rocks anc causing alot of dust,, so when we told him to back up on his own property and ride out of respect for my father he got mad and is know putting up a divider fence on his line therfore blcking acess to my property and leaving it tore up after saying they would fix it... The only way to get into my property is to take a portion of the original fence of mine down.. Which is fine but my question is can he just walk off and not fix the damage it didn't bother me till my father moved in because the damage was on the other side of the fence and the dust didn't make it to my house but know my father is there?

IF ITS YOUR PROPERTY CALL THE POLICE. there is laws againts property damage any court will find in your favor then put a lean on his property and forclose, I bet he fixes it fast. and pays you for your costs, time & trouble.

You need to have a survey of your property done by a licensed professional land surveyor, in order to be sure the area in question is actually a part of your property. Once you are certain that the area is yours, then you can file a lawsuit for trespassing and you may be able to recover damages.
