Who's responsible for residential tree removal in New Jersey? Tree owner, or neighbor?

My neighbor's been telling me for about 10 yrs that he's going to cut the tree and realizes it may fall on our house, but hasn't so we keep paying to prune it. Then he complains when some of the debris falls back into his yard.

You've been more than kind to pay for the pruning of his tree. You can have the site inspected to see about legally requiring him to cut the tree.

Perhaps give him an estimate of the damage that would occur (and that he would be responsible for) if the tree should fall.

I was told that if the tree on my property fell and landed on my neighbor's house that their home owner's insurance would have to cover the damage and vise verse.
Don't pay out any more money for pruning. The tree owner is responsible for pruning and taking out the tree if necessary. Talk to a lawyer or your mayor. Your neighbor would be held accountable for your damages if the tree fell onto your house.
