The laws on water rights vary from state to state. I'd check yours.
There needs to be someone come out and check the equipment and, of course, he needs to fix all his leaks. I'm surprised you haven't insisted on this before. Do you have outright ownership of the well and he pays you for water?
Water laws can be very complex but if the well is yours and he is running your well dry with his bad plumbing I would think that, at the very least, you could insist on his making repairs before you have to make repairs on the pump. Check it out with the Water Board in your area.
