I share a well with a neighbor . It is on my property. Can I insist that only a licensed pro can service it?

In CT. He has 3 tenants, and his faucets all leak, and the toilets run continuously. He thinks his foot-valve is bad, because he cannot get more than 40 lbs pressure from the pump. I think the foot-valve is fine, and the pump is bad, or all the leaks reduce his over-all pressure. I want to insist that he fix all the leaks, and have the pump serviced by a licensed pro, and then, and only then the pro can go in my well. I do not want the liability of my neighbor going in MY well, even if he has the right to take water from it? Any ideas?

A JOINT WELL IS BOTH OF YOURS EVEN THOUGH ITS ON YOUR PROPERTY. JUST A FEW QUESTIONS ARE YOU AT A LOSS OF WATER PRESSURE ALSO OR JUST HIM. IF ITS JUST HIM I WOULD SAY HE HAS A WATER LOGGED PRESSURE TANK(S).IF ITS BOTH OF YOU YOU ARE MOST LIKELY CORRECT MOST LIKELY NEED A PUMP. I WOULD NEVER RECOMEND PULLING PUMP WITH OUT PROPER EQUIPMENT. IF YOU WERE TO DROP THE PUMP IT WOULD COST YOU ALOT OF MONEY TO RETRIVE IT.AND YES IF YOU REMOVE THE PUMP YOU NEED TO SANATIZE(CLORINATE THE WELL.).

IF it is on your land and the deed gives you total rights to the land and water and minerals and stuff then it's YOURS......
The laws on water rights vary from state to state. I'd check yours.
There needs to be someone come out and check the equipment and, of course, he needs to fix all his leaks. I'm surprised you haven't insisted on this before. Do you have outright ownership of the well and he pays you for water?
Water laws can be very complex but if the well is yours and he is running your well dry with his bad plumbing I would think that, at the very least, you could insist on his making repairs before you have to make repairs on the pump. Check it out with the Water Board in your area.
