Who pays for the fence seperating my property and my neighbors property?

The current fence between us is probably at least 50 years old. It is in total disrepair and falling down. I bought the property 3 months ago and want to replace it. I would like to split the cost with my neighbor. Anyone know if there are any codes or laws regarding this subject? I would like to have my facts straight before broaching the subject with my neighbor.

It depends on who owns the fence. Is the fence acutally on your property? If the former owners of your home put the fence in or it's on your property, you own it and it is ultimately your responsibility. If it was put in by the developer right on the property line, you have shared ownership which doesn't mean that your neighbor has to share the cost of repairing it. If the fence is on your neighbor's property, he owns it and may elect not to repair it even if you pay half of the cost. If your neighbor owns a big dog or a pool and the condition of the fence is causing dangerous access, you can force him to repair it if he owns it. Most city ordinances require that a pool is fenced in. A better approach would be to talk to your neighbor and tell him that you think the fence should be repaired and ask if he would share the cost before you arm yourself with nuclear weapons. Remember, you have to live next to them and other things will come up. I am not an attorney, this information is just from my own experience. If you get into a disagreement with your neighbor over the fence, you should seek advice from an attorney to know for sure what your rights are.

You can pay for it, your neighbor can for for it, or you can split it as long as your neighbor is willing to pay half. It's called a good neighbor fence when it's split. There are no laws so it's up to you being nice to your neighbor. Keep in mind if your neighbor doesn't want to split it with you it may just mean that they have no money to do so.
It's traditional to split the cost, but I don't think it's mandatory. What if your neighbor just doesn't have the money?
If you are the one that wants to replace it..sorry to say but it is your responsibility to foot the bill. However, depending on how nice your neighbor is and if you remind him that it will increase his property value, maybe he will be willing to pitch in
In the UK the deeds say which side of the property your fence is located. (Looking towards the street, the left or the right). Sometimes, it will be stated that it is a common boundary which means you both share and agree the type etc.
Go to the county and find out exactly where you property line is. Another indication as to whose fence it is is if the finished side is in your yard or your neighbors.

Foe example, here in MN: If you decide to put the fence up yourself, you will need to ensure that the fence is 1 or 2 feet on your side of the property line. You cant run it on the property line.

You could talk to the neighbour in putting one up but also be sure to talk about post fencing issues like repair and maintenance, painting, etc etc.
If the fence material is on the outside of the posts, it's probably yours. Ask the neighbor if he would be willing to go half on cost. Have one person build the fence for continuity on the construction of the fence.
