My neighbour is building a dividing fence on my property. What can I do to prevent this happening?

have a surveyor from the city and mark the property line and as long as the fence is on his side of the line there is nothing you can do about it.

First you could try talking to them and asking them to put the fence on their own property as they are the ones who want it. Second, and it is worth it, fork out the few hundred bucks, get a land survey done on your property, and have the law back you up if the fence is placed on your property. (It is possible it may not be.) If the neighbour does put it on your property AND refuses to fix it after you have the survey in your hands, you can now legally take him to court to force him to take the fence down. GL
If you have a property deed and a survey,and your neighbor IS building the fence on your property, ask your neighbor to move it.
If he/she will not comply, contact your community's zoning board.
Do it immediately, since if you permit the neighbor to do this, it may be seen as compliance. After a certain period of time, it will also be considered legal.

If you are certain its on your property, Tear it down. If its on the property line, thats another matter. If you want to do things for legal purposes have it surveyed -
Put up a No Trespass Sign, several near the Fence- that gives you a lot of Legal ammo. If he continues, you can have him Arrested for ignoring the Signs.

A lot of places require a building permit for a fence. This is so the builder complies w/ the local building code. e.g. what side is required to face his property, offset from property and even the height. You local code enforcement agency should be great help. In the end you may not be able to prevent it from being built, but you can be a pain in the a.... to him.
Just convince him pushing back a little ! LOL !!
If your sure it's on your property, call the proper authorities. They can't just build a fence wherever they want to
