That would depend entirely on the codes in your area, call the zoning office or the equivilent...
There could be a right-of-way, finished buildings are tough to move 10 or 12 feet I would check for sure.

This depends on where you want to put it. I would place it at least 15-20 feet from the runoff taking into account the highest volume runoff.
