Negligence/neighbors tree falling on home?

The short answer is "yes you can". The long answer is that you need to do some homework now. If your neighbor is aware that the tree is likely to fall and damage your property, and does nothing about it, he can be proved negligent.
Best advice is to spend $100.00 for the written opinion of a certified arborist. Assuming that the finds the tree likely to fall, send your neighbor a registered letter outlining your concerns along with a copy of the arborists report. Take lots of pictures and save all correspondence. You are building the evidence you may someday need if the neighbor does nothing and you suffer a casualty claim.

if you can show that he knew the tree was going to do it... yes.. but if lightning strikes the tree and it falls into your home... no. your homeowners insurance will have to pick up the bill as its an act of god. if he knows it is rotten, or has cause to believe it is, and you can prove it, then go for the civil suit
first you need to tell him to get the over hanging limbs cut..then if he doesn't,call your local police dept. but if it does fall before you get to all this..he should have property insurance.if not sue the heck out of him...

call your city to ask what they can do - you could probably hire an arbourist to see if the trees are really a danger
why wait until the tree falls?? talk to your neighbour, then call the city, then call and arbourist. if the arbourist thinks it's a danger the neighbour has to remove it.
